  • OSPI Special Education Technical Assistance Paper No. 2 (TAP 2) Revised

    This paper covers the discipline requirements for students who receive special education services under the Individuals with Disabilities Education Act (IDEA). It contains a general overview of the discipline requirements as well as information on the provision of educational services during disciplinary removals; removals under special circumstances; manifestation determinations; disagreements about manifestation determinations, disciplinary placements or services during removals; and protections for students not yet eligible for special education services.

  • Discipline in Schools: A Parent Guide

    This guide is structured in a Q&A format and covers information such as what behaviors can result in discipline, actions a school can take, when a student can be removed from a classroom, suspension, etc. Also, this guide clarifies what constitutes a suspension and states “Sending a student home early or requesting a student stay at home for behavioral violations is a suspension.” To access this guide in other languages, click here, and look under Family Resources.



  • Dear Colleague Letter on the Inclusion of Behavioral Supports, August 1, 2016

    Issued by the U.S. Department of Education’s Office of Special Education and Rehabilitative Resources (OSERS). This letter clarifies that a failure to consider and provide for needed behavioral supports through the IEP process is likely to result in a child not receiving a meaningful educational benefit or FAPE. A Summary for Stakeholders is also available that summarizes the main points of the Dear Colleague letter.



  • Questions and Answers on Discipline Procedures

    This document was produced by the U.S. Department of Education’s Office of Special Education and Rehabilitative Resources (OSERS) in June 2009 to provide guidance on discipline policies enacted for school-age students to personnel in state and local educational agencies, and families. Topics addressed include: Safeguards; Definitions; Interim alternative educational settings; Hearings; Functional Behavior Assessments (FBA) and Behavior Intervention Plans (BIP); and Manifestation Determinations.
