      Issued in January 13, 2010, this letter provides clarification of the Individuals with Disabilities Education Act (IDEA) as it applies to children with disabilities requiring special education and related services who have high cognition as well as how other laws apply to this population.
    • OSERS Letter to Dr. Jim Delisle
      Issued in December 20, 2013, this letter provides clarification of the Individuals with Disabilities Education Act (IDEA) and its implementing regulations as they apply to children who have high cognition and who may have specific learning disabilities (SLD).
    • Identification of Students with Specific Learning Disabilities
      Published by the Office of the Superintendent of Public Instruction in December 2014.
      This document describes the procedures for Specific Learning Disability (SLD) eligibility determination that are required in addition to the evaluation/reevaluation process for determining eligibility for special education services for a student with a disability.
    • Students with ADHD and Section 504: A Resource Guide
      Through this letter and the accompanying Resource Guide, OCR seeks to help educators, families, students, and other stakeholders better understand these laws as they pertain to students with ADHD in elementary and secondary schools in order to ensure that these students receive the regular or special education, related aids and services, or supplementary aids and services the student needs to be successful.

      Issued on February 20, 2004 by the U.S. Department of Education’s Office of Special Education Programs. This letter contains guidance on whether it is permissible for a public agency to restrict a parent’s choice of an IEE to only the evaluators on a list provided to the parent by the public agency and whether the public agency has the ultimate authority to choose the evaluator.
